By accessing or using Notcheeya's website, platform, or services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and others who access or use the service.

Notcheeya provides business formation, branding, legal document preparation, compliance, and related services. Our services include but are not limited to LLC formation, registered agent services, EIN procurement, trademark filing assistance, logo and brand identity creation, and access to our freelance marketplace.

We are not a law firm and do not provide legal advice. Information provided through our platform is for general informational purposes only and should not be construed as legal, tax, or financial advice.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.

• Maintain and promptly update your account information.

• Keep your password confidential and not share it with third parties.

• Notify us immediately of any unauthorized use of your account.

• Accept responsibility for all activities that occur under your account.

Certain services require payment of fees. By providing payment information, you authorize us to charge the applicable fees. All fees are in U.S. dollars. State filing fees are government fees paid directly to the applicable state agency and are separate from Notcheeya's service fees.

Subscription plans are billed on a recurring basis (monthly or annually) until cancelled. You may cancel your subscription at any time from your account dashboard. Refunds are subject to our Refund Policy.

Notcheeya offers a 60-day money-back guarantee on plan service fees. State filing fees, government fees, and third-party fees are non-refundable once submitted. To request a refund, contact [email protected] within 60 days of your purchase date.

The Notcheeya platform, including its design, text, graphics, logos, and software, is owned by Notcheeya and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Brand assets (logos, color palettes, brand kits) generated through our platform for your business are owned by you upon payment and delivery.

You agree not to:

• Use the service for any unlawful purpose or in violation of any regulations.

• Submit false or misleading information in connection with business formation filings.

• Attempt to gain unauthorized access to any part of the platform.

• Interfere with or disrupt the integrity or performance of the service.

• Use automated means to access the service without our express permission.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NOTCHEEYA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTCHEEYA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

These Terms shall be governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Maricopa County, Arizona.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the service after changes constitutes acceptance of the new Terms.
